These Terms of Service ("Terms") govern your access to and use of arkansasmobilehomebuyer.com (the "Site"), operated by Titan Property Investors ("we," "us," or "our"). By using the Site, you agree to these Terms. These Terms contain a binding individual arbitration agreement, a class-action waiver, and a jury-trial waiver. Please read them carefully.
Informational use only
The content on this Site is provided for general informational purposes only. Nothing on the Site constitutes a binding offer to purchase real estate, legal advice, financial advice, or tax advice. Any cash offer we provide is non-binding until both parties sign a written purchase agreement.
Investor disclosure — not a licensed real estate broker
Titan Property Investors is a private real estate investment company. We buy property for our own investment account with the intent to resell, rent, repair and resell, assign our purchase contract, or otherwise profit from the transaction. We are not acting as your real estate agent, broker, attorney, lender, appraiser, inspector, or fiduciary, and we owe you no fiduciary duty. The price we offer reflects our investment criteria and is typically below full retail market value. You are encouraged, and have the right, to obtain independent legal, tax, financial, and real estate advice and to compare our offer to other options, including listing with a licensed Arkansas real estate professional, before signing any agreement.

No guarantees
Examples, timelines, testimonials, and offer estimates shown on the Site are illustrative and not a guarantee of any specific outcome. Each property and seller situation is different.
Electronic communications and signatures (E-SIGN)
By using the Site or contacting us, you consent to receive communications from us electronically (including by email, text, and electronically delivered documents). You agree that electronic signatures, contracts, notices, disclosures, and other records satisfy any legal requirement that such records be in writing, in compliance with the federal E-SIGN Act and applicable state law.
Call and message recording
We may record or monitor calls and retain copies of text messages with you for quality, training, compliance, and recordkeeping. By communicating with us, you consent to such recording and retention.
Marketing & photo release
If we visit, evaluate, or purchase your property, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use exterior and interior photographs, video, drone footage, and the property address (after closing) for our marketing, listing, training, and case-study materials. You may request that we limit the use of identifying information by emailing us.
Acceptable use
You agree not to misuse the Site, including by attempting to gain unauthorized access, scraping data, transmitting harmful code, or submitting false information.
Intellectual property
All content on the Site, including text, graphics, logos, and images, is owned by or licensed to Titan Property Investors and is protected by applicable laws. You may not reproduce or distribute Site content without our written permission.
Third-party links
The Site may contain links to third-party websites. We are not responsible for the content, policies, or practices of those third parties.
Disclaimer of warranties
The Site is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
Limitation of liability
To the fullest extent permitted by law, Titan Property Investors and its owners, members, managers, employees, agents, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, or business interruption, arising from or related to your use of the Site, any communications resulting from your inquiry, or any cash offer (whether non-binding or contained in a written agreement). In any event, our aggregate liability arising from or relating to the Site or your inquiry shall not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow these limitations, so they may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless Titan Property Investors and its owners, members, managers, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (i) your use of the Site, (ii) your violation of these Terms, (iii) your violation of any law or third-party right, or (iv) any information you submit to us being false, misleading, or unauthorized.
Binding individual arbitration; class-action and jury waiver
Any dispute, claim, or controversy arising out of or relating to the Site, these Terms, our communications with you, or any non-binding cash offer (each a "Dispute") shall be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before a single arbitrator, in Pulaski County, Arkansas, or by telephone or video at your election. The Federal Arbitration Act governs the interpretation and enforcement of this provision. You and we each waive the right to a trial by jury and the right to participate in a class action, collective action, consolidated action, or representative action. The arbitrator may award only individual relief and may not consolidate claims. If the class-action waiver is found unenforceable as to a particular claim, that claim must be severed and litigated in court, while all other claims continue in arbitration. This provision does not apply to (a) small-claims court actions brought on an individual basis, or (b) actions to enforce intellectual-property rights. Opt-out: you may opt out of this arbitration agreement by emailing titanpropertyinvestors@gmail.com with the subject line "Arbitration Opt-Out" within thirty (30) days of first using the Site or accepting these Terms.
Governing law
These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law principles. Subject to the arbitration provision above, any Dispute that proceeds in court shall be brought exclusively in the state or federal courts located in Pulaski County, Arkansas, and you consent to personal jurisdiction and venue there.
Statute of limitations
To the fullest extent permitted by law, any claim arising out of or related to the Site or these Terms must be filed within one (1) year after the claim accrues, or it is permanently barred.
Force majeure
We are not liable for any delay or failure to perform caused by events outside our reasonable control, including acts of God, natural disasters, epidemics, government action, war, civil unrest, labor disputes, utility or internet outages, or supply-chain disruption.
Severability and entire agreement
If any provision of these Terms is held unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will remain in full force. These Terms, together with our Privacy Policy and SMS Terms, constitute the entire agreement between you and us regarding the Site and supersede any prior agreements.
Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms and any purchase contract at any time, including to an affiliate, end-buyer, or successor.
Changes
We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
